Each Lot is sold subject to conditions of sale. Legal Packs
Copies of the legal packs including Special Conditions are usually available from the respective Seller's solicitors (for a small charge). Alternatively legal packs may be inspected at the Auctioneer's offices. Fox Grant do not guarantee they hold complete information about the property in these packs.
Questions
The Auctioneers and solicitors are pleased to answer any questions prior to the Auction. No questions can be taken during the Auction as this will delay the sale and inconvenience other bidders.
Insurance
Once the gavel falls the Buyer is usually responsible for the insurance of the property. Purchasers should make enquiries before purchase to ensure the necessary arrangements can be put into effect immediately upon sale.
Completion
This is normally 28 days after Auction or the date the Lot is sold prior to or post Auction, unless otherwise specified in the Special Conditions.
Order of Sale & Lot Changes
The order of sale is subject to change.
Registration of Interest
Buyers must register their interest in Lots in writing by email, fax or letter. By doing this, the Auctioneers will make reasonable endeavours to inform you of any changes to guide prices, Addendums or if the Lot is to be sold prior or withdrawn.
Sales Prior
The Auctioneers reserve the right to sell or withdraw Lots prior to Auction.
Auction Guide
The guide price does not represent a valuation by the Auctioneer and is indicative only. It may be subject to change at any time.
Auction Reserve
All Lots sell with reserve unless otherwise advised. The Reserve Price for any Lot might exceed or be lower than the guide price quoted at any time for that Lot.
Bidding Process
The Seller or their Agents reserve the right to bid, or sequentially bid, on behalf of the Seller at the Auction, up to, but not including the Reserve Price.
Liability of Bidder
If a lot is "knocked down" to you by the Auctioneer, a legally binding contract is immediately created. The terms of sale are those set out in the Conditions of Sale above. If you do not complete the Memorandum of Sale or pay the Deposit, the Auctioneers have the right to re-offer the Lot for sale and to treat you (and your principal if you are bidding as agent or representative) as being in breach of contract. Even if the Lot is re-offered for sale, the Seller might have a legal right of action against you for the breach of contract.
Deposit
Deposit cheques are for 10% (minimum of £3,000), unless otherwise stated, are payable at the Contract Date to Fox Grant Statutory Client's A/C and should be drawn on a UK clearing bank which is a member of CHAPS Limited. Cheques will be cleared as soon as possible. Please ensure that you have adequate funds in the appropriate account. Cash is not accepted.
Auction Admin Charge
£350 inclusive of VAT will be payable for EACH LOT. A Buyer who buys a number of different Lots will pay the Charge for each Lot purchased. For the avoidance of doubt, this Charge is payable by the Buyer whether sold prior to, at Auction or post. Cheques payable to Fox Grant.
Proof of Identity
Further to Money Laundering Regulations brought into effect in 2004, all successful bidders at Auction will be required to produce documentation to confirm their name and residential address. Below are some examples of acceptable identification: Photo ID - Current signed passport OR Current full UK/EU photo card driving licence; Address ID - Utility bill issued within the last 3 months OR Bank or building society statement.
